When booking with us Thistle Apartments you might be asked to pay 25% of full agreed lease term amount. You agree and entering in Contract between you (the Hirer) and us (Thistle Apartments). You also agree that Thistle Apartments only acts as leasing agent and offers booked apartment on behalf of private apartment owner (Client).

These are terms and conditions of contract.

1. Booking

Most of bookings are made in advance and apartments are subjects to availability, we reserve the right not to accept the booking for any good reason. All reservation are provisional until confirmed in writing. Booking acceptance must be confirmed in writing by Thistle Apartments by email.

2. Payment

You will be asked to provide a credit or debit card at the time of booking to secure your reservation. The credit card provided must belong to guest making reservation. Credit or debit card is to provide us with security against accidental damages or other unexpected expenses incurred during your stay. Full remaining agreed amount of total lease term must be paid 2 weeks (14 days) before arrival. In the event that founds has not been cleared we reserve the right to treat your provisional booking as cancelled and re let the property.

3. Noise Complaints

I agree to limit the noise to the minimum during my occupancy with full respect for the neighbouring residence. I also agree to limit the noise to the minimum during the QUIET PERIOD between 8:00pm and 7:00am any day of the week and weekend. If the complaint is raised by the resident with in the building, I agree to respond to the complaint by reducing level of noise with in the leased property.

4. Letting period

Check in to the apartment is available from 14:00 hrs on the day of arrival and apartment must be vacated by 10:00 hrs on the day of departure.

Early or late check in is available if agreed and arranged with Thistle Apartments.

5. Cancellations and No Show

All bookings are cancellable without charge up to 14 days, 2 pm local time before arrival. Cancellation should be notified in writing. In case of cancellation less than 14 days or no show the full paid amount will be charged for agreed letting period. Cancellation insurance is not included there for we recommend you seek personal travel insurance policy.

6. Occupying Rights

The Maximum number of adults and children occupying apartment is listed on the booking confirmation and the Hirer agrees not to exceed maximum apartment capacity at any time during the lease period. Children older than 2 years old count as adults. Hirer will be responsible to take charge and look after the property. The Hirer shall not sub-let or reassign the premises unless agreed and permitted by Thistle Apartments in writing. The Hirer agrees and obliges themselves and his party to vacate the hired premises by end of agreed letting period and no right to remain in the property exist. The contract allows you to occupy the premises as a holiday let only and relating to section 12 (schedule 4, paragraph 8) of the Housing (Scotland) Act 1988 this is not assured tenancy.

7. Limitation of Liability

Thistle Apartments takes no responsibility and is not liable to you or your party for any accidents, losses, damage to property, injury, expense or inconvenience in consequence of breach of contract or arising from your fault or any other members occupying or visiting the rented property. Although some apartments have private and secure car parking bay, we are not liable for damage to guest vehicles.

8. Apartment Unavailability

If for any good reason the accommodations become unavailable to hirer, every effort will be made to find suitable alternative accommodation. If this is not possible all the payments will be refunded and we will have no further liability to you or your guests.

9. Obligation of Occupants

All guests are required to minimise the risk of fire, therefore smoking or use of candles is not permitted in the rented apartment nor in the residential complex it self. Thistle Apartments reserve the right to charge £150 if sighs of smoking detected. Hirer is required to leave property secure if unoccupied, close the windows and lock the doors. Hirer is required to leave rented property reasonably clean and tidy on day of departure. Thistle Apartments reserve the right to charge hirer up to £150 a deep cleaning charge if property left in an unacceptable mess. Keys for the apartments and electronic key for car park (if supplied) are to be returned on departure date. Thistle Apartments reserve the right to charge hirer £70 for door lock keys and £100 for electronic barrier key.

10. Damage to Property

The Hirer shall undertake every opportunity to take care and look after property during length of stay and report any damages as soon as they occur. Thistle Apartments reserve the right to charge for repairs, damages or replacement to accommodation and its inventory. The hirer undertakes to report and pay for any damage caused to the accommodation or for equipment lost or damaged beyond fair wear and tear or broken during his occupancy of the property.

11. Termination

Thistle Apartments reserve the right to terminate the contract and repossess the property at any time if unacceptable antisocial behaviour, damage to property cause or likely to cause annoyance or offence to other residence. In this case any payments (refund) will be at our discretion.

12. Access to Apartment

Thistle Apartments reserve the right to access rented apartments at any reasonable time.

13. Website Advertising

Although we make every effort to accurately advertise on our website, its content is not warranted. We reserve right to make continues improvements to the accommodations and its content without prior notice.

14. Local Parking Rules

The Hirer shall abide by the local parking rules which might state that only private motor vehicles can use private parking facilities. Commercial vehicles might not be permitted to park within the development car park. The Hirer shall check each apartment listing description or contact Thistle Apartment by email for information on local parking rules applicable to the chosen apartment, prior to booking accommodation.

15. Guest Complaints

Although we make every effort to resolve guest complaints or requests, please note that Thistle Apartments manages apartments on behalf of private apartment owners. If you are unhappy, have a comment relating to condition of your apartment or noted a fault, please contact us and ask for the „Complaint Form” and we will forward it the owner. We will make every effort to address and resolve your resealable request before check out date.
